Explore Yachting – Terms and Conditions
1. Booking and Payment:
1.1. A non-refundable deposit of 30%-40% is required to confirm a booking. The remaining balance must be paid 60 days before departure(depending on yacht provider)
1.2. Payments can be made via bank transfer or credit card.
2. Cancellation and Refund Policy:
2.1. Cancellations made 90 days or more prior to the charter start date will receive a refund of 75% of the total charter fee.
2.2 Cancellations made 36 to 90 days prior to the charter start date will receive a refund of 50% of the total charter fee.
2.3. No refunds will be provided for cancellations made within 35% of the charter start date.
3. Charter Amendments and Substitution:
3.1. Explore Yachting reserves the right to amend the charter itinerary or substitute the yacht with a vessel of similar or higher standard in the event of unforeseen circumstances (e.g., adverse weather conditions, technical issues) for the safety and well-being of guests and crew.
4. Insurance:
4.1. All yachts are fully insured. Guests are advised to have their own travel insurance to cover personal belongings, trip interruption, and any unforeseen circumstances.
5. Damage and Liability:
5.1. Guests are responsible for any damage caused to the yacht or its equipment due to negligence or reckless behavior during the charter. The cost of repairs will be deducted from the security deposit.
5.2. Explore Yachting shall not be liable for any injury, loss, damage, delay, or inconvenience arising from the use of the yacht, its equipment, or services provided.
6. Safety and Compliance:
6.1. Guests must comply with all safety instructions provided by the captain and crew. Failure to do so may result in the termination of the charter without refund.
7. Force Majeure:
7.1. Explore Yachting is not liable for any failure or delay in performance due to circumstances beyond our control, including but not limited to acts of nature, government actions, or other unforeseen events.
8. Dispute Resolution:
8.1. Any disputes arising from this agreement will be resolved through arbitration in accordance with the laws of The Netherlands.
9. Governing Law:
9.1. This agreement is governed by the laws of The Netherlands, and any disputes will be subject to the exclusive jurisdiction of the courts in The Netherlands.
